Death
Penalty
From
this day forward, I no longer shall tinker with the
machinery of death. For more than 20 years I have endeavored--indeed,
I have struggled--along with a majority of this Court,
to develop procedural and substantive rules that would
lend more than the mere appearance of fairness to the
death penalty endeavor. Rather than continue to coddle
the Court's delusion that the desired level of fairness
has been achieved and the need for regulation eviscerated,
I feel morally and intellectually obligated simply
to concede that the death penalty experiment has failed.
It is virtually self evident to me now that no combination
of procedural rules or substantive regulations ever
can save the death penalty from its inherent constitutional
deficiencies.
Statement on the Death Penalty
The Blackmun dissent is consistent with the cjstudents.com
position on the death penalty. While a range of links follow,
we believe it is important to point out that the effectiveness
of the death penalty, for any purpose other than specific
deterrence and revenge, has not been demonstrated by criminological
research. Every crime control objective that is reached
through the death penalty can be effectively addressed
by other means.
Death penalty sites are prevalent on the internet. These
sites include a range of arguments. Many of these arguments
are based on respected research data. Others are based
on opinion. We encourage you to take an open mind into
the research process and ask whether one side of the argument
relies on opinion and emotion rather than research and
data.
